1. General
   All services of "AnanDao Noa Peekel – Training/Subscription/Online Products" ("AnanDao"), contracts with customers or participants (hereinafter referred to as "Participants"), including the initiation of business within the framework of AnanDao, are based on these General Terms and Conditions ("GTC"). Customers' terms and conditions to the contrary are only effective if they have been confirmed in writing. Verbal commitments and ancillary agreements require written confirmation. By registering, the participant declares that he/she has taken note of these T&Cs and accepts them in full.
   Deviating terms and conditions of the customer and the participant will not be recognized unless AnanDao expressly agrees to their validity in writing. AnanDao is entitled to change the T&Cs and other terms and conditions with effect for the future. AnanDao will only make these changes for valid reasons, in particular due to new technical developments, extensions of services, changes in laws or jurisdiction or other equivalent reasons. If the change significantly disturbs the contractual balance between the participant and AnanDao, the change will not be made. In all other respects, changes require the consent of the participant. The participant agrees to be informed about changes to the GTC when logging in to the respective platform or by e-mail to the last e-mail address provided by him/her. They are considered approved if the participant does not object in writing or in text form (e.g. by e-mail or letter) within 8 weeks of receipt ("objection period"). AnanDao will point out this circumstance separately when notifying the change. If the Participant does not object to the amended T&Cs within the objection period of AnanDao or if the Participant continues to use the Services despite receipt of the notification of the change, the amended or supplementary T&Cs shall become effective against the Subscriber. If the participant objects in due time, he/she is entitled to terminate this contract, just like AnanDao. Any service fees paid in advance over the termination period will be refunded on a pro rata basis. In the notification of the changes, AnanDao will specifically point out the possibility of objection and termination, the deadline and the legal consequences, in particular with regard to a failure to object.
2. Registration and Payment Agreement
   The registration of the participant is binding. A contract is concluded by the submission of a registration form by the participant and by confirmation in text form. The contract is also concluded by filling out the online form provided on the website of AnanDao and sending it as well as the confirmation in text form. Before submitting the online registration, the participant can change and view the data at any time. However, the offer can only be submitted and transmitted if the participant has accepted these terms and conditions by clicking on the "Register now" button and has thereby included them in his/her offer. The confirmation shall be made without delay, as far as is feasible in the ordinary course of business. AnanDao stores the data provided by the customer with the respective registration date in a database. This data is not accessible to the customer. Reference is made to the corresponding data protection declaration. Furthermore, the invoice for the training fee will be sent with a payment term of 10 days. The prerequisite for eligibility is that the payment has been received by AnanDao before the start of the training.
3. Performances
   The education and training services correspond to the advertised content. AnanDao reserves the right to change or adjust non-essential services at short notice.
4. Non-participation/rebooking
   Since only a limited number of participants are admitted to the AnanDao trainings, the entire training fee remains payable even if you do not participate. Saved expenses are credited. If the reserved space can be occupied elsewhere for a fee, AnanDao will take into account the income generated from it. The participant is free to prove that the aforementioned claim did not arise or did not arise in the required amount. A rebooking to another training start is free of charge up to 6 weeks before the original date, after that a rebooking is only possible to the next training start and only for a flat rate of 250 €. A rebooking to another face-to-face course date is only possible for a date offered at the time of registration and only for a flat fee of 250 €. In order for rebooking requests to be taken into account, each notification of a rebooking request must be in text form. The nomination of a substitute participant by the original participant is possible at any time before the start of the training.
   In the event of cancellation of an event/course or part of a course through no fault of your own (e.g. due to illness of the course instructor, a pandemic, an online service or force majeure), the entitlement to the full participation fee remains. AnanDao will make every effort to make up for the cancelled event/date or part of the course within a reasonable period of time. In this case, AnanDao is entitled to have the course held by other lecturers or to change the course/training times. If only one part of the course is cancelled (e.g. a face-to-face date due to illness or due to a pandemic), the entitlement to implementation and remuneration of the feasible course parts (e.g. content of the online academy or other course dates) remains valid as long as the remaining course parts cover the entire subject area of the training or AnanDao immediately offers replacement solutions for the cancelled course parts.
5. Knowledge transfer and copyright
   The knowledge and documents imparted in the AnanDao training may only be used for the participant's own teaching. Any other disclosure to third parties, in any form whatsoever, is not permitted. All documents handed over enjoy copyright protection and the trademarks AnanDao, DaoYoga, trademark and marking protection. Irrespective of the existence of copyright protection, the transfer, duplication, distribution and/or making publicly available of the documents (even in extracts), the access data to the Online Academy and the use of the trademarks without the written consent of AnanDao is also contractually prohibited. Video or audio recordings during the AnanDao trainings are prohibited. In order to ensure the best possible quality, the name AnanDao, DaoYoga and their designations may only be used by participants in the Continuing Education Partner Program and only in the spellings, shapes and sizes specified by AnanDao.
6. Liability
   In the training to become a Certified AnanDao DaoYoga Teacher, participants learn various techniques and sequences. How the knowledge and techniques learned are used by the training participants depends on the different needs and professional legal frameworks. The techniques taught by AnanDao are used by each training graduate on their own responsibility, within the framework of their professional profile and professional law, always observing the applicable rules and regulations. The participant indemnifies AnanDao from any liability. In the event of cancellation of an AnanDao training course or parts of the training due to force majeure, there is no entitlement to implementation. In this respect, the above applies; the appointment will be made up as soon as possible on a date communicated by AnanDao. Due to breach of contractual and non-contractual obligations, in particular due to impossibility, delay, fault in the initiation of a contract and tortious acts, AnanDao is liable — also for its employees and vicarious agents — only in cases of intent and gross negligence, limited to the damage typical of the contract that was foreseeable at the time of conclusion of the contract. These restrictions do not apply in the event of culpable breach of essential contractual obligations (cardinal obligations), in the absence of warranted properties, in cases of mandatory liability under the Product Liability Act or in the event of injury to body, life or health.
   When actively participating in the trainings, the course participants are obliged to report physical complaints and limitations so that no injury to body, life, freedom or health is in question. In the event of physical limitations, the participant undertakes to actively participate exclusively in the treatment part. If the physical limitations have not been disclosed, liability is completely excluded.
   With regard to data or content that is or was publicly available in accordance with the AnanDao Terms and Conditions and the AnanDao Data Protection Regulations and has been stored by a third party, AnanDao is under no obligation to prevent such storage by the third party.
7. Termination, exclusion
   AnanDao is entitled to immediately terminate the participation contract and/or to exclude the participant if he violates § 5, does not follow an order or instruction of the teacher or contravenes the house rules of the seminar premises. Termination or exclusion shall have no effect on the obligation to pay the training fee. We reserve the right to assert further claims, in particular claims for damages.
8. Clientele, choice of law, place of jurisdiction
   The range of services is aimed exclusively at certified yoga teachers. The law of the Land of Israel applies. The place of jurisdiction is, as far as legally permissible, Tel Aviv. General Terms and Conditions of AnanDao, for the Conduct of AnanDao DaoYoga
9. Withdrawal
   Insofar as the purpose of the ordered delivery and service cannot be attributed to the commercial or self-employed professional activity of the customer, i.e. in the event that the customer is only a consumer with no connection to his commercial or self-employed activity, there is a right of withdrawal. The contractual declaration can be revoked within two weeks without giving reasons in text form (e.g. letter or e-mail). The period begins upon receipt of this instruction, but not before the conclusion of the contract and also not before fulfilment of our duties to provide information pursuant to Article 246 § 2 in conjunction with § 1 (1) and (2) of the Introductory Act to the German Civil Code (EGBGB) and our obligations pursuant to § 312 g (1) sentence 1 of the German Civil Code (BGB) in conjunction with Article 246 § 3 of the Introductory Act to the German Civil Code (EGBGB).
   In order to comply with the revocation period, it is sufficient to send the revocation in good time before the expiry of the deadline. However, the revocation is and will only be effective if it is received properly and in due time. 10. Consequences of revocation
    In the event of an effective revocation, the services received by both parties must be returned and, if applicable, any benefits received must be remunerated or returned. Payments received and made on this contract will be refunded immediately, no later than 14 days from the day on which we received the notification of withdrawal from the contract. No fees will be charged for repayment. If the service received cannot be returned in whole or in part or can only be returned in a deteriorated condition, compensation for value will be claimed in this respect. If the revocation of the contract takes place within the 14-day period, but so late that the course or further training has already been completed and used in full, the compensation for value corresponds to the agreed remuneration for this course/further training.
